Suvimie Associates (Private) Limited offers their products on this website subject to the following terms, conditions and limitations.

These Terms and Conditions constitute an agreement between you (hereinafter referred to as , "you" or "your") and Suvimie Associates (Private) Limited a company incorporated in the Democratic Socialist Republic of Sri Lanka and having its registered office at 62, Wattalpola Road, Wattalpola, Panadura (hereinafter collectively referred to as, "us," "our," "we," or "Suvimie,"), in relation to your use of the website, the products/services offered and sold through this website and any orders you place through the website. Before you place an order, please carefully read these Terms and Conditions and our Privacy Policy.

Use of the website

  • You may only use the website to make legitimate orders or inquiries. If we are of the opinion that a speculative or fraudulent order has been made, we shall be entitled to cancel such order.

  • You agree to provide correct and accurate email, postal and/or other contact details to us and acknowledge that we may use these details to contact you in the event that this should prove necessary (see our Privacy Policy for more information on how we use your personal information).

  • If you do not give us all of the information that we need, we may not be able to complete your order and we shall not be held responsible for the same.

Product availability

All orders for products displayed on the website are subject to availability and in this regard, in the event of supply difficulties or because products are no longer in stock, we reserve the right to give you information about substitute products of an equal or higher quality and value which you can order. If you do not wish to order such substitute products, we will refund any monies that you might have paid.

If you have chosen the Pick- up in store option, we reserve the right to subsequently notify you that the product(s) you have ordered are not available for pick up.

Legally binding contract

No contract in respect of the purchase of products offered on the website shall exist between you and us until your order has been accepted by us and we send you an order confirmation by way of email.

Pricing and Payment Terms

  • Prices of products is as quoted on the website from time to time.

  • Prices exclude delivery costs which will be automatically added as set out in Clause 7 to the total amount due on the items added to the shopping basket (“order value”) upon selection of the delivery method at the point of checkout from the website.

  • Prices quoted on the website are subject to change from time to time, but such changes will not affect orders with respect to which an order confirmation has already been sent.

  • This website contains a large number of products offered for sale by Suvimie and it is always possible that, despite our best efforts, some of the products listed on the website may be incorrectly priced. Prices are normally verified prior to dispatch of the order, and where the correct price is less than the amount stated on the website, the lower amount will be charged. If the correct price is higher than the price stated on the website, Suvime will at its discretion contact the customer for instructions before dispatching the product or reject the order and notify you of such rejection.

  • Payment for all orders must be made by credit or debit card on the checkout page.

  • You should be aware that online payment transactions are subject to validation checks by your card issuer and the Suvime shall not be held responsible if your card issuer declines to authorize payment for any reason. Suvimie will not dispatch products until the payment has been processed. It is possible that your card issuer may charge an online handling/processing fee and in such an event Suvimie shall not be held responsible for such charge.

Refusal of order

We reserve the right to withdraw any product from the website at any time and/or remove or edit any materials or content on the website. While we will make reasonable efforts to process all orders, there may be exceptional circumstances that may require us to refuse to process an order after we have sent you an order confirmation; and we reserve the right to refuse to process an order at any time, at our sole discretion. If we refuse your order and funds have already been deducted from your account, the funds will be fully refunded.

Pick Up

  • If you choose the pick up in store option, you can arrange for pick up between 9.30 am and 6.00 pm from the Suvimie outlet specified in the order confirmation.

  • In order to pick up the order from a Suvime outlet, you or the person picking up the order on your behalf must produce a copy of the order confirmation.

Delivery

  • Delivery shall only be available within areas set out on our website for orders above a value of LKR 2,000/-.

  • Subject to exceptional circumstances beyond our control, we endeavor to deliver all orders within three days of the order confirmation and a delivery charge of LKR 350 shall be added to the order value.

  • In the event you require delivery within 24 hours and select the “Express Delivery” option on our website an express delivery charge of LKR 150 will be added to your order value.

Returns

  • In circumstances where you consider that the product does not conform to your order, you should promptly contact us with details of the product and a description of the defect.

  • You may return the product to us at any Suvimie outlet. Upon receipt of the returned product we will fully examine the product and if any defect exists, we will issue a credit note to purchase any item from our store or a refund will be made in full.

Intellectual Property

  • Suvimie ‘s trade mark and trade dress may not be used in connection with any product which is not produced, distributed or marketed by Suvimie, in any manner that is likely to cause confusion among customers or in a manner which disparages or discredits Suvimie.

  • The intellectual property rights in all content made available to you through or on this website remains the property of Suvimie.

  • You are not permitted to publish, manipulate, distribute or otherwise reproduce in any format, any of the content or copies of the content supplied to you or which appears to you on this website and use the same in connection with any business or commercial enterprise.

Limitation of Liability

  • You expressly agree that the use of this website is at your sole risk. Suvimie makes no representations or warranties of any kind, express or implied as to the operation of this website, information, content, materials or products included on this website to the extent permissible by applicable law.

  • Suvimie does not warrant that its website, server or e-mails sent from Suvimie are free of any viruses or harmful components and will not be liable for any damages arising therefrom.

Severability

If any of these Terms and Conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition

Right to modify these terms

We have the right to revise these Terms and Conditions at any time and you will be subject to the Terms and Conditions in force at the time at which you place the order.

Governing Law

These Terms and Conditions are governed by and shall be construed in accordance with the laws of Sri Lanka. All proceedings arising out of or in connection with this these Terms and Conditions shall be subject to the jurisdiction of the Courts of Sri Lanka.
